Smoker costs landlady £80 fine

A Lowestoft publican has been fined after health and safety officers caught a person smoking inside her pub.

Paula Fox was questioned by health and safety officers on August 25 2011 when they were passing The Bank Stores pub, Lowestoft, and saw a person smoking in the lobby.

Mrs Fox, 47, claimed she tried to stop people smoking inside the lobby entrance to the pub, but people did not always listen.

Victoria Nutley, prosecuting on behalf of Waveney District Council, said: “On August 25 two health and safety officers were travelling past Bank Stores and saw a man standing in the lobby entrance smoking.

“They pulled over the car and spoke to Paula Fox who said she had spoken to customers in the past and informed them to stop smoking inside.”

Mrs Fox, who represented herself at Lowestoft Magistrates’ Court, said: “I find it hard. Some listen to me and some don’t.”

She pleaded guilty to failing to prevent smoking in a smoke-free premises. She was fined £80 and ordered to pay £165 costs.

I would hope her customers stand by her and have a whip round to pay the fine. I certainly would and so would many other smokers.

Fined for failing to prevent smoking???? .I never thought I'd see the day when it would be an offence to fail to do something simply because your incapable of doing it. but then, this is a smoking issue, logic and common sense don't apply any more.

Feel free to smoke but its unfair to polute the air of those that dont, its selfish. I feel sorry for the landlady

Martin: if the landlady were allowed by law to provide acceptable indoor accomodation to her smoking customers, she wouldn't be in her perdicament. I also hope the contributions come flooding in.

I wonder how freedom and cigarettes can be mentioned in the same sentence. Cigarettes are highly addictive and take your freedom away, you become a lifelong slave to tobacco, and will eventually kill yourself and others around you. I believe this group here is sponsored or set-up by tobacco companies, who would do anything to delude the public. Smoking is the biggest pandemic these days and should be totally restricted and eventually phased out. I can only congratulate the government for putting the health of its country over the profits of tobacco companies. WELL DONE UK!!!

Why oh why do Smokerphobics come on this site. Please leave it to those who are fighting for their RIGHT to live their lives as they so wish, to contribute to this site. The whole world is full of smoker-hating interfering people like yourself and they feel the need to offend, snipe and I would go so far as to now call it "hate-crime" the way people think they can speak about smokers, so Lil, go find a nice ANTI smoking site to go on and you can call us to your heart's content. But remember, if you like a drop of the hard stuff or are over 9stone wet-through, they will be coming after YOU soon!! Bet you cant wait till the tee-total skinny's feel they can speak with utter contempt and disgust at what is, primarily, your RIGHT to do as you choose.

And I think you would be far better off looking after people who NEED it, rather than coming on a pro-smoking site and putting your four penn'oth in.
Perhaps you could volunteer to help and advise people who are addicted to lethal ILLEGAL substances rather than tut tut at those of us who CHOOSE to smoke tobacco which is perfectly legal. In fact, I'm wondering why on earth you do visit this site when you are so obviously one of the Anti's. Find a site that will enjoy listening to your preaching.

So I take it you want the freedom to choose to die a slow and painful death of lung cancer caused by smoking.
How sane do you think this sounds?

And on a different note, if a substance is legal or illegal makes no difference, in actual fact legal lethal substances deserve more attention, especially tobacco, as it is a worldwide pandemic that kills more people than malaria and aids combined. ond the only ones profiting from tobacco, are the companies, which you, as a slave of tobacco and your addiction, support.

I stopped smoking 4 days ago after 16 years.
I thought I enjoyed smoking, that it was a choice, but after quitting, I realise the reality is that I've been an addict to this drug nicotine, and now required to go through the withdrawal symptoms just like any other addict.
I'm not thin, nor am I a non-drinker, but the difference to smoking is I that I genuinely have a choice whether I drink or eat certain things, but with smoking, I NEEDED a cigarette every few hours.
I kidded myself for years I liked smoking, reality is I was just taking my drug to get me back to the same state as a non-smoker (not that you realise that when you are a long term smoker).

Why am I on here - not to preach, I am in no position to preach, but simply as I was just seeing what the views of smokers are compared to how I feel today. already I can feel myself being relieved that I am getting free of the nicotine hold on my life.

I'm personally glad that smoking is now banned in public places and hope that this gets extended. Also it's nice that I'm not facing a huge cigarette display when going into the supermarket as they are already getting ready for the changes later this year. I've failed to quit many times before, I have no doubt it is easier this time without the constant reminders and smells of continuing smokers.

I wish all you smokers well. I accept I will get abuse for this post, but maybe one person may quit from reading this. I'm using Champix to assist this time, and although the side affects of upset stomach are a little unpleasant, its not for long and then I'm free for the rest of my life!

I've been away for a couple of days.
You know, I really c.b.a. to argue. "Choose to die a slow and painful death"? Nice One. What a wonderful quesion! Whoopie Do, yay, of Course I want to die a slow and painful death!!!! Ahhh what an idiot. Like I say I c.b.a. to talk to you any more. Anti, Smokerphobic, whatever. Enjoy your time on here, telling off this and that. Get a cause.

Well, I'm still smoke free and no longer miss it! Excitedly I see the ozzies are looking at banning smoking in pub gardens too, good, hope the UK follows suit! Less young people that get hooked the happier I will be.

Martin who you trying to kid you may think you are smoke free but the slightest bit of stress you get your be back on them. I have tried champix twice and have given up twice each time for 2 months at a time but now i am back smoking. Your alright why your on champix once off your be back. Do you know what even if i had managed to stay off the fags i still would have supported smokers unlike you. You are nothing more then a turn coat. It is smokers rights to be able to enjoy a cigarette in peace without these annoying anti smokers trying to tell you how to run our life. It is wrong of aussie's to ban smoking in pub gardens they wanted us outside now they bloody well want us not to smoke outside who the bloody hell do these people think they are. My advice to any smokers if you get told you cannot smoke outside calmly walk back inside to enjoy your fagits not fair they want it both ways

Errrm still not smoking, gave up the champix after 4 weeks, just kept reducing the dose. I am now in Australia and its noticable how few people smoke here. Already my flight here has been piqued for simply by not smoking. At 2k per annum saved, I can now enjoy exotic holidays instead of smoking.
